Local Government Cash Proffer Survey

Cash Proffer – A cash proffer is (a) any money voluntarily proffered in a writing signed by the owner of property subject to rezoning, submitted as part of a rezoning application, and accepted by a locality pursuant to the authority granted by Va. Code Ann. Section 15.2-2303 or Section 15.2-2298, or (b) any payment of money made pursuant to a development agreement entered into under authority granted by Va. Code Ann. Section 15.2-2303.1.

Fiscal Year 2008-09 Survey
The Annual Cash Proffer Survey for Fiscal Year 2008-09 began in July 2009. The Commission mailed the survey instrument to the chief administrative officer of every locality with a population over 3,500, with a request to return the survey by Sept.30, 2009. Electronic versions of the survey instrument are available for downloading here. (Word) The Commission completed its report on the FY 2008-09 survey in November 2009.

Background
Section 15.2-2303.2 of the Code of Virginia requires the Virginia Commission on Local Government to survey annually the acceptance of cash proffers by eligible localities. Only localities with populations over 3,500 are required to report. The survey is designed to assist the General Assembly in determining the amount of cash proffer revenues and expenditures of local governments and the purposes for which such expenditures were made beginning in FY2000 and for each fiscal year thereafter.
In that regard, in July of each calendar year the Commission requests that the chief administrative officer, or other appropriate official, in affected counties, cities, and towns across the State provide essential information about cash proffers in their respective localities for the preceding fiscal year.

The Commission has published the results of its survey since November 2001 and copies of all of the reports  have been made available to the public and the chairmen of the Senate Local Government Committee and the House Counties, Cities, and Towns Committee.
